What makes rideshare accident cases different

  • 1

Rideshare company coverage changes depending on the driver's app status at the time of the crash.

  • 2

Passengers, other drivers and pedestrians may each have different claims.

  • 3

Rideshare companies keep trip data you will need, so it has to be requested early.

Florida

Rules that affect your claim

Filing deadline

2 years

For most injury claims (Fla. Stat. § 95.11(4)(a)). 2 years for negligence claims that arose on or after March 24, 2023 (HB 837). Older claims had 4 years.

Fault rule

Modified comparative fault (51% bar)

You can recover as long as you were not more than 50% at fault, and your award is reduced by your share of the blame. Medical malpractice cases still use pure comparative fault. (Fla. Stat. § 768.81)

Car insurance

No-fault state

Your own personal injury protection (PIP) coverage pays your medical bills and some lost wages first, no matter who caused the crash. You can sue the at-fault driver only if your injuries meet the state's threshold.

Pending attorney review. General information, not legal advice. Deadlines can be shorter for claims against government agencies and for some case types.
