Know this
What makes slip and fall cases different
- 1
You generally must show the owner knew or should have known about the hazard.
- 2
Your own share of fault (for example, not watching where you walked) is often disputed.
- 3
Claims against a city or public agency can have very short notice deadlines.
Checklist
Evidence to save now
- Photos of the hazard exactly as it was, before it is cleaned up
- An incident report from the store or property manager
- The shoes you were wearing
- Witness contact details
- Medical records and bills

Questions to ask a lawyer
- 1.Have you handled premises cases against this kind of property (store, apartment, city sidewalk)?
- 2.How will you get surveillance video before it is deleted?
- 3.What is your contingency fee and how are costs handled?
Florida
Rules that affect your claim
Filing deadline
2 years
For most injury claims (Fla. Stat. § 95.11(4)(a)). 2 years for negligence claims that arose on or after March 24, 2023 (HB 837). Older claims had 4 years.
Fault rule
Modified comparative fault (51% bar)
You can recover as long as you were not more than 50% at fault, and your award is reduced by your share of the blame. Medical malpractice cases still use pure comparative fault. (Fla. Stat. § 768.81)
Car insurance
No-fault state
Your own personal injury protection (PIP) coverage pays your medical bills and some lost wages first, no matter who caused the crash. You can sue the at-fault driver only if your injuries meet the state's threshold.
Pending attorney review. General information, not legal advice. Deadlines can be shorter for claims against government agencies and for some case types.
